1. Agreement to Terms
These Terms of Use (“Terms”) govern your access to and use of the website located at https://www.athghincenter.org (the “Site”), and any materials, reflections, resources, or features made available through it (collectively, the “Offerings”).
By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Site.
2. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Site. By using the Site, you represent and warrant that you meet this requirement.
3. Account Registration
Some areas of the Site may invite you to create an account or provide information (for example, to access the newsletter, register for gatherings, or participate in a community space). You agree to:
provide accurate, current, and complete information;
update your information as needed;
keep your login credentials confidential; and
notify us promptly of any unauthorized use of your account.
You are responsible for all activity that occurs under your account.
4. Purpose and Nature of the Site
This Site exists to support Athghin Center and those interested in its development. The Offerings are intended for educational, spiritual, and formative purposes only.
Nothing on this Site is intended to replace professional mental health care, medical advice, pastoral counseling, or therapy. If you are experiencing a mental health crisis or require immediate assistance, please seek help from a qualified professional or emergency service in your area.
5. Acceptable Use
You agree to use the Site in a manner consistent with its contemplative and respectful purpose. You agree not to:
use the Site for any unlawful, fraudulent, or harmful purpose;
attempt to gain unauthorized access to any systems or networks;
interfere with or disrupt the operation of the Site;
post or transmit content that is abusive, harassing, deceptive, obscene, or otherwise harmful;
misrepresent yourself or your intentions within the community;
reverse engineer or attempt to derive source code from the Site; or
use automated tools (scripts, bots, scraping) in a way that places unreasonable strain on our infrastructure.
We reserve the right to suspend or terminate access if we believe these Terms or the spirit of this space are being violated.
6. Intellectual Property
All content and materials on the Site—including text, prayers, reflections, graphics, icons, images, audio, video, and other materials—are owned by or licensed to the Center and are protected by intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to access and use the Site for your personal, non-commercial use in accordance with these Terms. You may not reproduce, distribute, modify, or create derivative works from our content without express written permission.
7. User Content
If you submit reflections, prayers, comments, or other content (“User Content”), you grant the Center a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute that content solely in connection with operating and sustaining the Site and its contemplative mission.
You remain responsible for your User Content and represent that:
you have the right to share it; and
it does not infringe the rights of others or violate any law.
We reserve the right to remove content that, in our discernment, does not align with the purpose or tone of this space.
8. Third-Party Services
The Site may include links to third-party websites or resources. We do not control these services and are not responsible for their content or practices. Your use of third-party sites is at your own discretion and subject to their terms.
9. Disclaimers
The Site and its Offerings are provided “as is” and “as available.” To the fullest extent permitted by law, the Center disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Site will be uninterrupted, secure, or error-free, or that any particular spiritual or personal outcome will result from its use.
10. Limitation of Liability
To the fullest extent permitted by law, the Center and its directors, staff, volunteers, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site.
Our total liability for any claim arising out of or relating to these Terms or the Site will not exceed $100 USD.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.
11. Indemnification
You agree to indemnify and hold harmless the Center and its directors, staff, volunteers, and agents from any claims, damages, or expenses arising out of:
your use of the Site;
your violation of these Terms; or
your violation of any rights of another person.
12. Changes to the Terms
We may update these Terms from time to time. The updated version will be posted on the Site with a revised “Last Updated” date. Your continued use of the Site after changes take effect constitutes your acceptance of the revised Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Ireland, without regard to its conflict of laws principles.
Any dispute arising out of or relating to these Terms or the Site shall be subject to the exclusive jurisdiction of the courts of that country.
Where applicable, the processing of personal data is governed by the General Data Protection Regulation (EU) 2016/679 (“GDPR”) and relevant national data protection laws. We commit to handling personal data in accordance with those standards.
